Please read these terms carefully before using GetAffiliated. By using our platform, you agree to be bound by these terms.

By accessing and using GetAffiliated (the "Platform"), operated by HubtersAI LLC, a Delaware limited liability company, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or platform notification.
"Founder" refers to businesses, brands, or individuals who create campaigns to promote their products or services through AI-driven affiliate marketing.
"Influencer" refers to content creators, marketers, or individuals who join campaigns to promote products or services in exchange for commissions.
"Campaign" refers to an AI-driven affiliate marketing program created by a Founder, including all associated terms, commission structures, and promotional materials.
"Commission" refers to the payment earned by an Influencer for successful referrals or sales generated through their unique affiliate link.
You must be at least 18 years old to use this Platform.
You must provide accurate, current, and complete information during registration and maintain the accuracy of such information.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may not create multiple accounts or use the Platform for fraudulent purposes.
Founders must provide accurate and truthful information about their products, services, and campaigns.
Founders are responsible for honoring all commission payments to Influencers according to the terms specified in their campaigns.
Founders must provide clear guidelines, prohibited content rules, and marketing assets for their campaigns.
Founders may not modify locked campaign terms (commission rate, attribution window, refund protection period, linked product) after publication. Modifiable terms (description, assets, guidelines, visibility status) may be updated at any time, but content published by Influencers prior to such updates remains valid and compliant based on the terms at the time of publication. Campaigns may only be extended before they expire.
Founders must comply with all applicable laws and regulations, including consumer protection, advertising standards, and data privacy laws.
Founders may not unilaterally remove an Influencer from a campaign. All removal requests must be submitted as a dispute to the Platform, and the Platform will make the final decision.
Founders are solely responsible for the quality, legality, and delivery of their products or services.
Influencers must comply with all campaign guidelines and prohibited content rules set by Founders.
Influencers must clearly disclose their affiliate relationship in accordance with FTC guidelines and applicable laws (e.g., using #ad, #affiliate, or similar disclosures).
Influencers may not engage in fraudulent activities, including but not limited to: self-referrals, click fraud, cookie stuffing, or misleading advertising.
Influencers must use marketing channels and content types approved by the campaign.
Influencers are responsible for the accuracy and legality of their promotional content.
Influencers may not disparage the Founder, their products, or the Platform in their promotional activities.
Influencers assume full responsibility for any reputational harm, brand damage, or product liability caused to the Founder by their content or conduct. The Platform acts solely as a facilitator and is not liable for any such damages.
Commission rates, attribution windows, and payment terms are defined by each individual campaign and agreed upon when an Influencer joins a campaign.
The Platform facilitates tracking and reporting of affiliate conversions but does not guarantee payment accuracy. Disputes should be resolved between Founders and Influencers.
The Platform charges a 5% platform fee on all affiliate sales (payable by the Founder) and a 10% platform fee on each Influencer payout, besides any applicable payout processing fees.
Founders will be charged every Tuesday for all valid and collectable affiliate commissions generated in the previous period.
Commissions are subject to a standard 7-day refund protection period and a mandatory 15-day dispute protection period before becoming collectable.
Influencers may request a payout anytime for available balances exceeding the $50 USD minimum threshold.
The Platform operates in USD as the base currency. Transactions involving other currencies are converted based on Stripe's exchange rate at the time of the charge or payout.
Conversions occurring after an Influencer has voluntarily left or been removed from a campaign are not eligible for commission. Previously valid and earned commissions remain payable subject to standard terms.
Users agree to be bound by the Stripe Connected Account Agreement. The Platform is not a bank and does not hold funds; all payment processing is performed by Stripe.
Users acknowledge that GetAffiliated has introduced them to their counterparts (Founders to Influencers and vice versa).
For a period of 12 months from the start of any relationship established through the Platform, Users agree not to solicit, contact, or contract with each other outside of the Platform for the purpose of avoiding Platform fees ('Disintermediation').
Any attempt to encourage or facilitate payments outside of the Platform is a material breach of these Terms and may result in immediate account termination and a fine equal to estimated lost fees.
The Platform and its original content, features, and functionality are owned by HubtersAI LLC and are protected by international copyright, trademark, and other intellectual property laws.
GetAffiliated is a trademark of HubtersAI LLC. You may not use our trademarks without prior written permission.
Founders retain ownership of their brand assets, product information, and marketing materials provided on the Platform.
Influencers retain ownership of the content (videos, images, text) they create ('Influencer Content'). However, by submitting content to a Campaign and accepting commissions, Influencers grant the Founder and HubtersAI LLC a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute said content for any marketing or promotional purpose.
This license includes the right for Founders to use Influencer Content in paid advertising (e.g., Facebook Ads, Social Media Ads) and other marketing materials without additional compensation, unless explicitly excluded in the specific campaign terms.
Users may not copy, modify, distribute, sell, or lease any part of the Platform or its content without explicit permission.
Users may not use the Platform for any illegal or unauthorized purpose.
Users may not engage in any activity that interferes with or disrupts the Platform or its servers.
Users may not attempt to gain unauthorized access to any portion of the Platform, other user accounts, or connected systems.
Users may not transmit any viruses, malware, or other malicious code.
Users may not harass, abuse, or harm other users of the Platform.
Users may not scrape, crawl, or use automated tools to access the Platform without permission.
Users may not promote illegal products, services, or activities through the Platform.
Users may not engage in spam, phishing, or other deceptive practices.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We collect, use, and protect your personal information in accordance with applicable data protection laws, including GDPR and CCPA where applicable.
Founders and Influencers are responsible for complying with data protection laws in their respective jurisdictions when handling customer data obtained through campaigns.
We use cookies and similar technologies to enhance user experience and track affiliate conversions. You can manage cookie preferences through your browser settings.
We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem appropriate.
You may terminate your account at any time by contacting our support team.
Upon termination, your right to use the Platform will immediately cease.
Termination does not relieve you of obligations incurred prior to termination, including payment obligations.
We may retain certain information as required by law or for legitimate business purposes after account termination.
The Platform reserves the right to issue warnings, temporarily suspend, or permanently terminate accounts for violations of these Terms. The severity of the action taken will depend on the nature and frequency of the violation.
Grounds for Founder Account Suspension
• Commission Under-Reporting: Deliberate actions to under-report, manipulate, or falsify commission data to avoid paying Influencers their rightfully earned commissions. This includes but is not limited to: tampering with tracking systems, manually adjusting conversion data without legitimate cause, or providing false refund claims.
• Non-Payment of Commissions: Repeated failure to pay Influencers within the agreed timeframe without valid justification, or systematic withholding of earned commissions.
• False or Misleading Campaign Information: Creating campaigns with deceptive product descriptions, fake testimonials, misleading pricing, or other fraudulent information that could harm Influencers or their audiences.
• Product Non-Delivery: Consistent failure to deliver products or services to customers referred by Influencers, resulting in chargebacks, refunds, or damage to Influencer reputation.
• Violation of Campaign Modification Rules: Unauthorized modification of locked campaign terms (commission rate, attribution window, refund protection period, linked product) after publication without Platform approval.
• Harassment or Abuse: Harassing, threatening, or abusing Influencers through the Platform's messaging system or in dispute resolution processes.
• Illegal Products or Services: Promoting products or services that violate applicable laws, including but not limited to: counterfeit goods, illegal substances, pyramid schemes, or prohibited financial products.
• Intellectual Property Violations: Using copyrighted materials, trademarks, or other intellectual property without proper authorization in campaign materials.
• Data Privacy Violations: Misusing Influencer or customer data, failing to comply with GDPR, CCPA, or other applicable data protection regulations.
• Multiple Account Abuse: Creating multiple Founder accounts to circumvent platform fees, evade suspension, or manipulate the system.
Grounds for Influencer Account Suspension
• Affiliate Fraud: Engaging in fraudulent activities to generate false commissions, including but not limited to: self-referrals, click fraud, cookie stuffing, incentivized clicks, bot traffic, or creating fake accounts to generate conversions.
• FTC Disclosure Violations: Repeated failure to properly disclose affiliate relationships in promotional content as required by FTC guidelines and applicable laws.
• Campaign Guideline Violations: Systematic or severe violations of Founder-specified campaign guidelines, including use of prohibited content, unauthorized marketing channels, or misleading advertising.
• Trademark or Brand Misuse: Unauthorized use of Founder trademarks, brand names, or intellectual property in ways that violate campaign terms or applicable law, including bidding on branded keywords without permission.
• Spam and Unsolicited Marketing: Sending unsolicited emails, messages, or other communications to promote affiliate links, or engaging in spam tactics across any platform.
• Negative or Defamatory Content: Creating content that disparages, defames, or falsely represents the Founder, their products, or the Platform after joining a campaign.
• Chargeback Abuse: Systematically generating sales that result in chargebacks, refunds, or returns, indicating low-quality traffic or fraudulent promotion tactics.
• Impersonation: Impersonating the Founder, their brand, or falsely claiming official partnership status beyond what is authorized in the campaign terms.
• Multiple Account Abuse: Creating multiple Influencer accounts to join the same campaign multiple times, evade suspension, or manipulate commission structures.
• Data Scraping or System Manipulation: Using automated tools to scrape campaign data, manipulate tracking systems, or interfere with Platform functionality.
Enforcement Actions
• First Warning: For minor or first-time violations, the Platform may issue a written warning and require corrective action within a specified timeframe.
• Temporary Suspension: For moderate violations or repeated minor violations, accounts may be temporarily suspended for 7-30 days. During suspension, users cannot access certain Platform features, create new campaigns (Founders), or join new campaigns (Influencers).
• Permanent Termination: For severe violations, repeated violations after warnings, or fraudulent activities, accounts may be permanently terminated. Users with terminated accounts are prohibited from creating new accounts.
• Commission Withholding: In cases of fraud or Terms violations, the Platform may withhold or reverse commissions pending investigation. Legitimate commissions will be released upon resolution.
• Legal Action: The Platform reserves the right to pursue legal action for violations involving fraud, intellectual property theft, or other illegal activities, and may report such activities to relevant authorities.
Financial Penalties (Extreme Cases Only)
• Fraud & Theft: Users engaging in fraudulent activities (click fraud, commission manipulation, fake conversions, identity theft) will be fined 300% of the fraudulent amount or $1,000 minimum, whichever is greater, plus permanent account termination and potential legal action.
• Commission Theft (Founders): Deliberately withholding or under-reporting sales to avoid paying earned commissions will result in immediate payment of owed commissions plus a 200% penalty fine, permanent account termination, and potential legal action.
• Severe Data Privacy Violations: Intentional GDPR/CCPA violations, data breaches caused by negligence, or unauthorized data sharing will result in fines of $5,000-$25,000 depending on severity and number of affected users, plus mandatory third-party security audit at violator's expense and permanent account termination.
• Multiple Account Abuse: Creating duplicate accounts to circumvent platform limits or bans will result in $1,000 fine per duplicate account, permanent ban of all accounts, forfeiture of all pending commissions, and potential legal action.
• Fine Payment Terms: All fines must be paid within 30 days of notification. Unpaid fines may result in collection action and legal proceedings. Fines may be deducted from pending commissions or account balances.
• Appeal Process: Users may appeal fines within 45 days by submitting evidence to info@getaffiliated.net. Appeals are reviewed within 15 business days. Appealing does not suspend fine payment obligations unless explicitly granted by Platform.
Warning System for Non-Extreme Violations
• First Violation: Written warning and explanation of violation
• Second Violation: Final written warning and 7-day account restriction
• Third Violation: 30-day account suspension
• Fourth Violation: Permanent account termination
• Note: Warnings apply to non-extreme violations such as minor guideline breaches, late content submissions, FTC disclosure issues, spam, harassment, or unintentional policy violations. Extreme violations (fraud, theft, severe privacy breaches, multiple account abuse) result in immediate fines and termination without warnings.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not guarantee that the Platform will be uninterrupted, secure, or error-free.
We do not guarantee the accuracy, completeness, or reliability of any content on the Platform.
We are not responsible for the quality, safety, or legality of products or services promoted through campaigns.
We are not responsible for the conduct of Founders or Influencers, or for any disputes between them.
We do not guarantee that Influencers will earn any specific amount of commissions, or that Founders will achieve any specific results from their campaigns.
THE PLATFORM ACTS SOLELY AS A FACILITATOR. SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NO LIABILITY FOR INDIRECT, CONSEQUENTIAL, OR LOSS OF BRAND REPUTATION DAMAGES CAUSED BY USERS.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless HubtersAI LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from:
• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your content or promotional materials
• Any products or services you promote or sell through the Platform
Platform Authority: The Platform retains the ultimate right of interpretation regarding technical validity of conversions, fraud detection, and attribution logic. Its determinations on these matters are final for Platform account purposes.
Stage 1 - Internal Resolution: All disputes regarding platform activity, commissions, or user conduct must first be submitted through the appropriate Platform interface within the specific timeframe applicable to the dispute category. Users agree to cooperate in good faith and provide requested evidence. The Platform's decision on technical validity and attribution is final for platform purposes.
Stage 2 - Binding Arbitration: If a dispute cannot be resolved through the internal process, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to waive your right to participate in class action lawsuits or class-wide arbitration.
The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
Notwithstanding the above, either party may seek injunctive relief in court to prevent irreparable harm (e.g., intellectual property theft).
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
You agree to submit to the personal jurisdiction of the courts located in Delaware for any actions not subject to arbitration.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and HubtersAI LLC regarding the Platform.
